1. Agreement to Terms

By accessing and using TalkNToast ("Platform," "Service," "Website," or "Application"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms in their entirety, you must not access or use this Platform.

TalkNToast ("Company," "we," "us," "our") operates this Platform as a communication and social networking service. These Terms apply to all users, regardless of how you access the Platform (website, mobile application, or any other medium).

2. Platform Nature & Critical Disclaimer

TalkNToast does not:

• Verify user identities, backgrounds, relationships, or intentions
• Conduct criminal background checks on users
• Verify user age or authenticity of photos
• Guarantee user safety during meetups or communications
• Monitor or control all user interactions and conversations
• Accept responsibility for harmful outcomes from user interactions
• Validate the accuracy of any information provided by users
• Assume responsibility for physical, emotional, or financial harm resulting from user connections

The Platform is provided "AS IS" and "AS AVAILABLE" without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or accuracy.

3. Age Requirement

You must be at least 18 years of age to access and use the Platform. By creating an account or using the Platform, you represent and warrant that:

• You are at least 18 years old
• You have the legal authority to enter into this Agreement
• You are not prohibited by law from using the Platform
• All information you provide is true and accurate

4. No Identity Verification - Critical Understanding

We explicitly do NOT verify user identities. This means:

• Users could misrepresent their identity, age, appearance, location, or relationship status
• Profile photos may not be authentic or current
• Biographical information may not be accurate
• Users may be using fake identities or fraudulent accounts
• Married, committed, or underage individuals may access the Platform

You must assume all users may be misrepresenting themselves. Exercise extreme caution when interacting on the Platform and independently verify information before meeting anyone in person or sharing personal details.

5. User Conduct & Prohibited Activities

You agree not to use the Platform to:

• Violate any applicable laws or regulations
• Harass, threaten, intimidate, defame, or abuse other users
• Post sexually explicit, abusive, or offensive content
• Engage in fraud, scams, catfishing, or deceptive practices
• Solicit money or financial information from other users
• Share nude photos of others without consent
• Engage in illegal activities or exploitation
• Post content that infringes on intellectual property rights
• Spam, phish, or attempt to hack the Platform
• Impersonate other individuals or create fake accounts
• Upload prohibited content including child exploitation material
• Stalk, follow, or violate the privacy of other users
• Use the Platform for commercial solicitation without authorization

Violations may result in immediate account termination, permanent ban, and potential legal action.

6. Limitation of Liability - TalkNToast's Non-Responsibility

In no event shall TalkNToast, its parent, affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages.

To the fullest extent permitted by law, TalkNToast's liability is limited to the amount you paid to us in the past 12 months, if any, or $100, whichever is less.

7. Indemnification

You agree to indemnify, defend, and hold harmless TalkNToast and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your user content or actions on the Platform
• Your interactions with other users
• Any harm you cause or experience as a result of meeting other users
• Any claim by third parties related to your conduct

8. User Safety & Personal Responsibility

Your safety is your responsibility. TalkNToast is a platform with no control over user conduct before, during, or after in-person meetings.

We recommend:

• Always meet in public places initially
• Inform a trusted friend of your meetup location and time
• Trust your instincts and leave if something feels unsafe
• Independently verify information about users before meeting
• Never share personal financial information with users
• Use caution before disclosing home address, workplace, or regular locations
• Be cautious when sharing intimate photos or videos
• Do not accept rides or travel alone with users you've just met
• Avoid excessive alcohol consumption during meetups
• Report suspicious activity to authorities and TalkNToast

9. User Content & Intellectual Property Rights

By posting content to TalkNToast, you retain ownership of your content but grant TalkNToast a worldwide, royalty-free, perpetual license to use, reproduce, modify, distribute, and display your content in connection with the Platform.

You represent and warrant that:

• You own or have permission to use all content you post
• The content does not violate third-party rights
• You have obtained consent from any individuals in photos or videos (especially nude photos)

TalkNToast reserves the right to remove content that violates these Terms or is illegal.

10. Termination

TalkNToast reserves the right to terminate or suspend your account at any time, for any reason or no reason, without prior notice or liability. Reasons for termination include but are not limited to:

• Violation of these Terms
• Violation of applicable laws
• Harassment or abuse of other users or staff
• Posting prohibited content
• Fraudulent or deceptive conduct
• Payment issues or chargebacks
• Inactivity

Upon termination, your access to the Platform will immediately cease. TalkNToast may delete your account and all associated data without liability.

11. Dispute Resolution & Governing Law

These Terms are governed by applicable law. Any disputes arising from these Terms or your use of the Platform shall be resolved in accordance with applicable jurisdiction laws.

By using the Platform, you waive your right to litigate disputes in court and agree that any dispute shall be resolved through binding arbitration or small claims court.

12. Changes to Terms

TalkNToast reserves the right to modify these Terms at any time. Changes are effective upon posting. Your continued use of the Platform after changes means you accept the modified Terms. We encourage you to review these Terms periodically.
